My dad is seriously ill. Can my job let me take leave without firing me?
Can I take time off work to care for a sick parent?
Concerns & risks
You were trying to keep your job and be there for your dad after his diagnosis, but you're scared that asking for time off will cost you your position.
Caregiving shouldn't cost you your job.
Causes & evidence
The FMLA gives eligible employees job-protected unpaid leave to care for a parent with a serious health condition. See FMLA leave.
What to do
- Check if you're eligible (employer size, time worked, hours).
- Tell your employer as early as possible.
- Ask HR for FMLA paperwork.
- Check your state for extra paid leave laws.
Common mistakes: Common mistakes: waiting until a crisis to say anything. If the need is foreseeable, the FMLA generally expects about 30 days' notice, or as soon as practicable. You don't have to say the words 'FMLA' at first, but give enough information that your employer understands it may qualify. Not every worker is covered: the employer usually needs 50 or more employees within 75 miles, and you generally need 12 months on the job and 1,250 hours in the past year. Ask HR for the leave paperwork and the medical certification form, and give the doctor plenty of time to fill it out. Keep copies of everything, including emails. Also check your state's laws, since some states offer their own family leave, sometimes paid. If you can't take a long block, ask about intermittent leave for appointments. Keep your manager informed about a return plan.
Speed Man tip: Keep copies of all forms.
Wrap-up: FMLA may apply. Check eligibility. Notify early.
